9. Donations

In Portugal, the application of VAT (Value Added Tax) to donations depends on the nature of the donation and the circumstances under which it is made.

Cash Donations

Cash donations are not subject to VAT, as they do not constitute a supply of goods or services under Articles 3 and 4 of the VAT Code (CIVA). Therefore, there is no need to issue an invoice under the CIVA; issuing a receipt as proof of the donation is sufficient.

In-Kind Donations

Donations in kind (tangible goods) may be subject to VAT, depending on certain factors:

  • VAT Liability: If the donor (a VAT-registered person) has deducted all or part of the VAT on the purchase of the goods they intend to donate, the donation is considered a transfer of goods subject to VAT, pursuant to Article 3(3)(f) of the VAT Code.

  • VAT Exemption: Article 15(10)(a) of the VAT Code provides for an exemption for the gratuitous transfer of goods to entities such as the State, private social welfare institutions, or non-profit nongovernmental organizations, provided that the goods are intended for subsequent distribution to people in need.

  • Exemption from VAT: Pursuant to Article 3(7) of the VAT Code, gifts of goods with a unit value of €50 or less, and whose total annual value does not exceed 5/1000 of the donor’s turnover in the preceding calendar year, are not subject to VAT, provided they fall within the scope of normal commercial practices.

Tax Documentation and Obligations

  • Cash Donations: It is not necessary to issue an invoice under the CIVA; a simple receipt is sufficient as proof of the donation.

  • Donations in Kind: When subject to VAT, the donor must issue an invoice reflecting the transaction, even if there is no financial consideration. If the transaction is exempt from VAT, the legal basis for the exemption must be stated on the invoice.

It is important for donors to review the applicable laws and, if necessary, seek tax advice to ensure proper compliance with the tax obligations associated with donations.
